Pay Transparency Act in British Columbia

Hey There!

We’re super excited to share some important news with you. B.C. has made a big leap forward in ensuring fair pay for everyone with the new Pay Transparency Act, which became law on May 11, 2023. This law is all about closing the gender pay gap and tackling unfair pay practices. Let’s break down what this means for you and your business.

What You Need to Know About the Pay Transparency Act

📢 Pay Secrecy? Not Anymore!

  • What’s the Deal? When you’re posting a job, you need to include what the pay will be or at least the pay range.
  • Why It’s Cool: It helps job seekers know what to expect right off the bat and promotes fairness in hiring.

🤫 No More Asking About Previous Pay

  • What’s the Deal? You can’t ask job candidates how much they made at their last job.
  • Why It’s Cool: This helps break the cycle of pay inequality and lets the focus be on what the job is worth now, not what someone was paid before.

🛡️ Protection for Talking Pay

  • What’s the Deal? Employees can freely talk about their pay with coworkers or ask about their own pay without fear of getting into trouble.
  • Why It’s Cool: Open conversations about pay help identify and fix unfair pay gaps.

📊 Pay Transparency Reports Are a Must

  • What’s the Deal? If your company is above a certain size, you’ll need to create and share a pay transparency report every year.
  • Why It’s Cool: These reports help shine a light on pay practices and push for more equal pay across the board.

Who Needs to Report and When?

The law rolls out in phases depending on your company’s size. Here’s the scoop:

  • By November 1, 2023: The B.C. government and the six biggest Crown corporations (like BC Hydro, ICBC, etc.).
  • By November 1, 2024: Companies with 1,000 or more employees.
  • By November 1, 2025: Companies with 300 or more employees.
  • By November 1, 2026: Companies with 50 or more employees.

Pro Tip: Count how many employees you have in B.C. on January 1 each year to see if you need to report.

Heads Up: The Minister of Finance will put out a yearly report by June 1 showing pay gaps and how well everyone is following the rules.
